DECLARATION OF COVENANTS, CONDITIONS
AND RESTRICTIONS AND GRANT OF EASEMENT
BY THE CLIFFS AT GLASSY, INC.
BY SPECIFIC GRANT DATED OCTOBER 26, 1997
AND RECORDED IN THE REGISTER OF DEEDS OFFICE
IN DEED BOOK 1726, PAGE 343
Article 13.9 as Contained in Declaration of Covenants,
Conditions and Restrictions for The Cliffs at Glassy, Inc.
Easement for Cemeteries. The Declarant reserves
for itself, the Association, the relatives of any deceased person
in any cemetery that is located within the boundaries of the Properties,
and persons seeking access to any such cemeteries for academic or
historical purposes, a nonexclusive, perpetual easement of ingress
and egress over such portions of the Common Areas which are necessary
to travel to and from such cemeteries.
Grantor, The Cliffs at Glassy, Inc. does hereby grant to the Grantee,
Emery/Lindsey Cemetery Association, Inc., their heirs and assigns,
full and free right and liberty for the Grantee, its members and
their visitors and guests, and in common with all others having
the like right, at all times hereunder, with or without vehicles
of any description, for all purposes connected with the use and
enjoyment of said land by the Grantee, to pass and re-pass along
the said private road for the purpose of going to or from the said
Emery/Lindsey Family Cemetery tract lying within the Greenville
Water Shed.
To have and to hold, furthermore, The Declarant
reserves for the Emery/Lindsey Family Cemetery Association, Inc.
(whose members are descendants of a deceased whose remains are located
within the family cemetery) located approximately ½ mile
north of Mount Hill Baptist Church and being with the Greenville
Water Shed, a non-exclusive, perpetual easement of ingress and egress
over such portions of the common areas and private roadways which
are necessary to travel to and from such cemetery.
